A Federal Capital Territory High Court, Zuba, Abuja presided over by Hon. Justice J.O. Ebong has struck out a civil suit brought against the Independent Corrupt Practices and Other Related Offences Commission (ICPC) by one Walida Mohammed purportedly seeking the enforcement of her fundamental human right against unlawful arrest and detention by the Commission.
Mohammed had brought the suit demanding the payment of the sum of Five Hundred Thousand Naira (N500,000:00) as compensation and an order of Perpetual Injunction restraining ICPC from further inviting, arresting, intimidating, harassing, threatening and detaining her in connection with a case the Commission was investigating.
The ICPC counsel, Barr. Adamu Dahiru and Barr. Eno Igbodaro-Yahaya, in their defense submitted that Walida Mohammed had failed to place any material fact(s) before the court to substantiate the claim. The counsel further averred that the provisions of the Corrupt Practices and Other Related Offences Act, 2000, include the powers to summon, arrest, investigate or detain any person or authority in Nigeria.
In his ruling, the presiding judge, Justice J.O Ebong struck out the suit in favour of ICPC.
